Terms of Service
1. Acceptance of terms
By creating an account or using websphere, you agree to these Terms of Service. If you're using the platform on behalf of an organization, you're agreeing on its behalf as well.
2. Use of the platform
websphere connects verified domain experts with enterprises and AI labs seeking specialized talent. Experts must provide accurate credentials; enterprises must provide accurate role and payment information. Misrepresentation may result in suspension.
3. Matching & screening
Fit scores and shortlists are generated by our AI matching engine and are provided as guidance, not guarantees of employment or hire quality. Final hiring decisions remain with the enterprise.
4. Payments
Payouts to experts are processed via Stripe Connect on a daily basis for completed, approved work. Enterprises are billed according to the engagement terms agreed at project setup. Fees and payment schedules are disclosed before any transaction is finalized.
5. Intellectual property
Work product delivered through the platform is governed by the engagement agreement between the expert and enterprise. websphere retains rights only to platform software, benchmarks, and aggregated, de-identified performance data.
6. Termination
Either party may close their account at any time. We may suspend accounts that violate these terms, misuse the platform, or compromise marketplace trust and safety.
7. Limitation of liability
websphere is provided "as is." We are not liable for indirect or consequential damages arising from use of the platform, to the maximum extent permitted by law.
8. Governing law
These terms are governed by the laws of the jurisdiction in which websphere is incorporated, without regard to conflict-of-law principles.
